Scheduling a Hearing (Ex Parte and Noticed Motion)

Ex Parte Hearing
An ex parte hearing is urgent and is requested by one party with short notice to the opposing party. Notice to the opposing party must be provided by 10:00 a.m. the day before the ex parte hearing. There is a fee for the ex parte hearing payable at the time of filing, unless you have a waiver of fee on file.

Noticed Motion
A noticed motion is when the opposing party was given advance notice of the hearing. You must serve the other party or their lawyer with a copy of your motion. Service to the other party or their lawyer may be done either by mail or in person. File the original motion and proof of service with the court. The California Rules of Court state how to prepare and when to file documents. There is a fee payable for the motion at the time of filing, unless you have a waiver of fee on file.

Please note that law and motion matters are heard by appointment ONLY in all civil IC departments as per Local Rule 2.1.19. Unscheduled motions will not be heard.

Reservations for most Civil Independent Calendar Department motions may be made using the Court’s Motion and Reservation System.

Cases assigned to Department 501 or 61 are not currently eligible for the Court’s Reserve a Motion Date application.

Hearing dates and times may be obtained by calling the Independent Calendar Department assigned to the case. Hearings may not be continued by phone.
