Scheduling a Hearing for Unlawful Detainer (Ex Parte and Motion)
Ex Parte
An ex parte hearing is an urgent matter and is requested by one party with short notice to the opposing party. Notice to the opposing party must be provided by 10:00 a.m. the day before the ex parte hearing. There is a fee for the ex parte hearing, payable at the time of filing, unless you have an approved fee waiver on file.
Ex parte filings must be filed with the Business Office no later than noon the day before the hearing.
All Unlawful Detainer cases are assigned and heard in the Central Division. To schedule an ex parte, please call the number below, or visit the Civil Business Office.
Noticed Motion
You are required to file the original motion and proof of service with the court. The California Rules of Court state how to prepare the motion and references filing deadlines. There is a fee for the motion, payable at the time of filing, unless you have an approved fee waiver on file. To schedule a noticed motion call the numbers listed below.
Pursuant to the General Order of the Presiding Department: In Re Procedures Regarding Electronically Imaged Court Records, Electronic Filing, and Access to Electronic Court Records in Civil and Probate Cases, and San Diego Superior Court (SDSC) Local Rule 2.1.4, all filings submitted by attorneys for represented parties in all limited and unlimited civil case types must be submitted electronically through one of the court’s approved e-Filing service providers (EFSPs), with exceptions for specific documents.
Please note that the Civil Business Office cannot vacate trial dates; however, if you have a trial scheduled and you have either settled your case in its entirety or have a pending stipulated judgment pending with the court, please contact (619) 450-7371. You will need to provide the following information: Case Number, Your Full Name, Party Affiliation (Plaintiff/Defendant), and telephone number. The clerk’s office will forward this information to the Department to address.
